Kolyzium — User/Subscriber Agreement
Effective Date: 09/11/2021

This User/Subscriber Agreement (the “Agreement”) is a legal contract between Lux Hub Online Boosting LLC, dba Kolyzium (“Kolyzium”, “we”, “us”, or “our”) and you, the individual purchasing or using Kolyzium services (“Subscriber”, “you”, or “your”). By creating an account, purchasing a plan, booking a session, or otherwise using the Kolyzium platform, you agree to be bound by this Agreement.

1. Eligibility & Account
These terms govern the use of our website.
– By using the website, you agree to these terms. If you do not agree, do not use the website.
– When you register or use our services, you will be asked to confirm your acceptance of these terms.
– You must be at least 13 years old to use the website. By using it, you confirm that you meet this requirement.
– Our website uses cookies. By using it, you consent to our use of cookies as explained in our Privacy and Cookies Policy.
– You must be at least 13 years old (or the age of majority in your jurisdiction) to subscribe. Minors may participate only with a parent/guardian as the account holder.
– You must maintain an active platform account and meet game-specific prerequisites (quests, levels, ownership of DLCs, etc.).
– You are responsible for the security of your Kolyzium account and your platform accounts.

– When registering, you must provide your PlayStation Network Online ID (“username”) and choose a password.
– Your username must not be misleading, must follow the content rules in Section 18, and cannot be used to impersonate others.
– Notify us immediately if your password is exposed or compromised.
– You are responsible for all activity on your account. Failure to protect your password may make you liable for any resulting losses.

2. License & Acceptable Use

You receive a limited, non-exclusive, non-sublicensable, revocable, and non-transferable license to access and use Kolyzium for your personal, non-commercial purposes.
-You must not:
• use the website for any unlawful, fraudulent, or harmful purpose.
• damage, disrupt, or impair the website’s performance or accessibility.
• upload, share, or distribute viruses, malware, or other harmful software.
• reproduce, modify, distribute, sell, resell, publicly display, or otherwise exploit the Services except as expressly permitted.
• decompile, reverse engineer, or disassemble the Services except as allowed by law.
• link to, mirror, or frame any portion of the Services without permission.
• launch scripts or programs that overload or hinder operation.
• attempt to gain unauthorized access to any part of the Services or related systems.
• run automated data collection (e.g., scraping, mining, harvesting) without our written consent.
• use bots, spiders, or automated tools to access the site (except search engine indexing).
• ignore or violate our robots.txt rules.
All information you provide through the website must be true, accurate, and not misleading.

3. Access, Accounts & Verification
– You must maintain accurate account information and may be required to verify age/identity to use certain features.
– You are responsible for device security and your login credentials. One account per Subscriber; accounts are non‑transferable.
– If previously banned, you may not re-register. Minors may participate only through a parent/guardian account and under their supervision.

4. Subscriptions, Payments & Tips
– To subscribe, you must select a plan and pay the applicable fee. We will confirm your order, and the subscription contract begins once we issue that confirmation.
– While your account and subscription are active, you will have access to the features listed for your chosen plan.
– We may change subscription benefits from time to time. If a change significantly reduces value or functionality, you may cancel your subscription and receive a refund for the unused period.
– Subscription or session fees are disclosed at checkout. Taxes and payment processor fees may apply.
– Unless otherwise stated, subscriptions auto-renew until cancelled. You may cancel at any time; cancellations take effect at the end of the then-current billing term.
– Tips to Hosts are optional; the typical range displayed in the app is $2–$6.
– Chargebacks or payment disputes may lead to account suspension pending resolution.

5. Cancellation and Suspension of Account
We may, at our discretion:
• update or edit your account details,
• temporarily suspend your account, or
• cancel your account.

If we cancel any paid services without your breach of these terms, you will receive a refund for the unused portion. We will provide reasonable written notice before cancellation.
You may cancel your account at any time through the Delete/Restore Profile option. No refunds will be issued if you choose to cancel your account.

6. Sessions (Booking, Bundling & Prep)
– Scheduling windows: Sessions are posted in Eastern Time (ET) and may occur in any of the Kolyzium time blocks: Early Morning (3:00–7:00 AM), Midday (9:00 AM–12:00 PM), Afternoon (12:00–6:00 PM), Night (9:00 PM–1:00 AM).
– Bundling: Kolyzium may group Subscribers pursuing similar goals into a shared session (target group size typically 3–12, title permitting). Solo assistance may be limited and is subject to availability.
– Session length: A standard session runs up to 2 hours 30 minutes (cap). Longer requests may require multiple bookings.
– Mandatory Game Submissions: Subscribers must submit a list of 3–5 focus games every 3 months. This requirement ensures efficient scheduling, proper bundling with other players, and alignment with available Hosts. Failure to provide an updated list may result in limited session availability.
– Prep & lobby post: Hosts post lobby details 2 hours before the scheduled start. You agree to join on time and to come prepared with any required loadouts or quest steps.
– Reminders: We may send SMS/email reminders ~3 hours and ~45 minutes before start. Messaging frequency may vary.

7. Rescheduling, No‑Shows & Make‑Goods
– Rescheduling by Subscriber: You may reschedule ≥25 hours before the scheduled start time via the app. Requests inside 25 hours are treated as no‑shows.
– Subscriber no‑show: If you fail to join within the 10-minute grace period, your reservation will not be guaranteed, and you will forfeit eligibility for refunds or credits. You may be re-queued at the end of the current cycle, subject to availability.
– Host no‑show or late reassignment: If Kolyzium cancels a session or the Host fails to appear, Support will either reassign the session or arrange a make-good (typically scheduled within 7 days, often on Thursday). Alternatively, Kolyzium may issue a session credit at its discretion. Any session credit will be divided among the reserved session players. Session credits have no cash value and may only be used within the platform.”
– Force majeure: Platform‑wide outages or verified emergencies may result in rescheduling without remedies.

8. Conduct & Fair Play
– Co op assistance only. No account sharing, cheating, or exploits. You must comply with each game’s Terms of Service and platform rules.
– Be respectful toward Hosts and other participants. Harassment, hate speech, or abusive behavior leads to immediate removal and can result in suspension or termination of your account.
– Recording/streaming a session requires express permission from all participants and Kolyzium.
– No PSN account sharing or gamesharing. Hosts will never ask for your PSN log in credentials. If anyone requests them, report it to Support immediately.
– No solicitation/advertising of off platform paid services or trades in Kolyzium lobbies or chats.

9. Report Abuse
– If you notice unlawful content or activity, or anything that violates these terms, please report it to us.
– You can report abuse by email or through the Support feature in your account.

10. Outcomes & Disclaimers
– Kolyzium commits to high‑quality co‑op assistance but does not guarantee specific outcomes (e.g., trophy drops subject to RNG, raid clears subject to skill/attempts).
– We are not liable for lost progress, account penalties, or bans resulting from your breach of game/platform rules.
– Scheduled durations are estimates; session flow may shift due to team size, mechanics, or platform stability.

11. Ratings, Feedback & Communications
– You agree to provide honest feedback and ratings after sessions.
– You consent to receive operational notices (e.g., schedule confirmations, reminders) by email, SMS, or in‑app messages. Standard messaging rates may apply.
– Support hours are typically Mon–Fri 9:00 AM–9:00 PM ET and Sat–Sun 12:00 PM–6:00 PM ET.

12. Disputes & Remedies
– If an issue arises, open a Support ticket within 48 hours of the session’s end time. Include screenshots or relevant details.
– Remedies may include a make‑good session, at Kolyzium’s discretion, considering attendance, progress made, and evidence provided.
– Abuse of the dispute process (e.g., bad‑faith claims, duplicate chargebacks) can lead to suspension.

13. Intellectual Property
– Kolyzium owns all rights in its platform, brand, and materials.
– You receive a limited, revocable, non‑transferable license to use the platform for personal, non‑commercial purposes.
– You grant Kolyzium a non‑exclusive license to display your submitted feedback (e.g., ratings) in anonymized form.

14. Privacy
– Kolyzium handles personal data in accordance with its Privacy Policy. Do not share sensitive data in chats beyond what Support requests to resolve issues.
– We comply with applicable U.S. data protection and privacy laws.

15. Service Changes & Downtime
– We may modify, suspend, or discontinue features or sessions (including rescheduling) for maintenance, safety, or operational reasons. Where practicable, we’ll provide notice and re‑book you without penalty.

16. Term; Suspension & Termination
– You may stop using the service at any time.
– Kolyzium may suspend or terminate your account for violations of this Agreement (e.g., harassment, cheating, repeated no‑shows, chargeback abuse) or for legal/compliance reasons.
– Termination does not relieve you of owed amounts or obligations accrued before termination.

17. Modifications; Termination
We may modify these terms at any time by posting an updated version. Continued use after the Effective Date of changes constitutes acceptance. We may suspend or terminate access to the Services at any time for any reason, including violations of this Agreement. Certain provisions (e.g., license restrictions, arbitration, limitations of liability) survive termination.

18. Your Content: Rules
– You confirm that any content you provide will comply with these terms.
– Your content must not be illegal, unlawful, infringe the rights of others, or expose anyone (including us) to legal claims under any applicable law.
– Specifically, your content (and our use of it under these terms) must not:
• be false, defamatory, obscene, indecent, or malicious.
• infringe intellectual property rights (copyright, trademarks, design rights, database rights, moral rights, or similar);
• breach privacy, confidentiality, or data protection laws.
• contain negligent statements or misleading advice.
• encourage or promote criminal activity.
• violate court orders or laws on discrimination, hatred, or official secrecy.
• breach any contractual obligations to others.
• depict explicit or gratuitous violence.
• be pornographic, sexually explicit, or lewd.
• be untrue, inaccurate, or misleading.
• contain harmful instructions that could cause injury, illness, death, or damage.
• constitute spam.
• be offensive, abusive, harassing, threatening, discriminatory, hateful, or otherwise harmful.

19. Network Access & Devices
– You are responsible for obtaining data network access and compatible devices. Messaging/data rates may apply.
– Kolyzium does not guarantee the Services will function on any particular hardware or device and the Services may be subject to internet/electronic communications delays and malfunctions.

20. Warranty Disclaimer/ Limitation and Exclusions Liability/ Indemnity
AS IS. The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied.
Limitation. To the maximum extent permitted by law, Kolyzium shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages (including lost profits, lost data, or loss of goodwill), or for any damages arising out of (i) your use of or inability to access the Services, or (ii) any transaction or relationship between you and any third party (e.g., game/platform providers). In all cases, Kolyzium’s total liability shall not exceed the greater of $100 or the amounts you paid to Kolyzium in the six (6) months preceding the claim.

Indemnity: You agree to indemnify and hold harmless Kolyzium and its affiliates from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of this Agreement, your misuse of the Services, or your violation of law or third‑party rights.

Nothing in this Agreement will:
– limit or exclude liability for death or personal injury caused by negligence.
– limit or exclude liability for fraud or fraudulent misrepresentation.
– restrict liability in ways not permitted by law; or
– exclude liabilities that cannot legally be excluded.

If you are a consumer, your statutory rights remain unaffected.
These limitations and exclusions apply to all liabilities arising under or in connection with this Agreement, whether in contract, tort (including negligence), or breach of statutory duty.
To the extent Services or information are provided free of charge, we are not liable for any resulting loss or damage.
– We are not liable for losses caused by events beyond our reasonable control.
– We are not liable for business-related losses such as loss of profits, income, contracts, goodwill, or anticipated savings.
– We are not liable for loss or corruption of data, databases, or software.
– We are not liable for any indirect, special, or consequential damages.

We do not warrant or represent:
(a) the completeness or accuracy of the information published on our website;
(b) that the material on the website is up to date; or
(c) that the website or any service on the website will remain available.

We reserve the right to discontinue or alter any or all of our website services, and to stop publishing our website, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any website services, or if we stop publishing the website.

To the maximum extent permitted by applicable law and subject to Section 20, we exclude all representations and warranties relating to the subject matter of these terms and conditions, our website and the use of our website.
You agree not to bring claims personally against our officers or employees or contractors. This does not limit the liability of the company itself for their actions or omissions.

Our total liability to you under this Agreement will not exceed the greater of (a) the amount you paid us for the Services, or (b) the total amount payable under this Agreement.

21. Third-Party Websites
Our website may contain links to third-party websites. These links are provided for convenience only and are not endorsements.
We do not control third-party websites or their content, and (subject to Section 20) we are not responsible for them or for any loss or damage that may result from your use of them.

22. Arbitration Agreement; Class Action & Jury Trial Waiver
Binding individual arbitration. You and Kolyzium agree to resolve any dispute, claim, or controversy arising from or relating to this Agreement or your use of the Services by final and binding arbitration on an individual basis, not in court. No class actions. The arbitrator may award relief only to the individual party seeking relief. Jury trial is waived.
Scope & rules. The arbitration will be administered by AAA (American Arbitration Association) under its Consumer Arbitration Rules (or JAMS if AAA is unavailable). The arbitration may be conducted by documents, teleconference, or video, unless an in‑person hearing is required. Venue, if any, will be Pinellas County, Florida, unless otherwise required by law. This clause survives termination.
Small claims exception. Either party may bring qualifying claims in small claims court.
30‑day opt‑out. You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing support@lux-hob.com with subject “Arbitration Opt‑Out”, your full name, and the email associated with your account.
Class/Mass action waiver. Claims must be brought in your individual capacity and may not be consolidated with other claims.

23. Assignment
We may assign, transfer, or subcontract our rights and obligations under these terms, provided that if you are a consumer, this will not reduce the protections you receive under these terms.
You may not assign, transfer, or subcontract your rights or obligations under these terms without our prior written consent.

24. Feedback & User Content License
By submitting feedback, ratings, or reviews, you grant Kolyzium a non‑exclusive, worldwide, royalty‑free, perpetual, irrevocable, sublicensable license to use, reproduce, display, and distribute such content in connection with operating and improving the Services. We may moderate or remove content that violates this Agreement or applicable law.

25. Severability
If any part of these terms is found to be unlawful or unenforceable, the rest will remain in effect.
If removing part of an unlawful or unenforceable provision makes it valid, that part will be removed and the rest will continue to apply.

26. Third-Party Rights
These terms are for the benefit of you and us only. No third party has any rights under this contract.
The parties may exercise their rights under these terms without needing approval or consent from any third party.

27. Governing Law & Venue
– This Agreement is governed by the laws of the State of Florida, USA, without regard to conflicts of law.
– Nothing in this Agreement limits rights under applicable U.S. consumer protection laws.
– Venue and jurisdiction for any permitted court action lie in Pinellas County, Florida.

28. Statutory and Regulatory Disclosures
We do not provide a personal copy of these terms for each user. If we update these terms, only the latest version will be available on our website. We recommend saving a copy for your records.
These terms are provided in English only.
Kolyzium is registered in the United States as Lux Hub Online Boosting LLC.
For dispute resolution, U.S. laws and arbitration procedures (as outlined in these terms) apply.
